MFC creators are suing Ubisoft over a claim that they first signed a deal with them to produce My Fitness Coach for the Wii, but then began work on My Weight Loss Coach after missing the Wii Fit launch window. The suit was filed on July 16 and seeks at least $26 million for a breach of license agreement and continued damage. The money will make up for licensing fees ResponDesign was expecting from Ubisoft as well as all the royalties.
ResponDesign claims that Ubisoft, "from the outset failed to diligently pursue development of the game, ignored the terms of the license agreement and acted in bad faith." After Ubisoft told ResponDesign the game wouldn't be ready until the first quarter of 2009, they began to complain about missing assets. In July, Ubisoft also informed ResponDesign that it would be changing the names from the "My Coach" line and labeling them Yourself!Fitness in the US and Go Fitness in Europe.
